Part 2 — Terms of Sale

1 General Provisions

2.1.1 These General Terms of Sale (the “General Terms”) apply to all products ordered through the Platform (the “Product” or “Products”).

2.1.2 Products are sold under these General Terms only to customers (the “Customers” or “Customer”) who are natural persons aged 18 or over acting for personal purposes outside their trade, business, craft or profession. By placing an order on the Platform, Customers agree and undertake that the purchase is not part of any transaction or dealing with entities or persons subject to United Nations, United States or European Union sanctions, or located in a country subject to comprehensive sanctions.

2.1.3 These Terms & Conditions are published in Arabic and English. If the two versions differ, the Arabic version prevails.

2.1.4 Customers must read these General Terms carefully. They are available on the Platform for Customers to review, save and retrieve, and they constitute an agreement between Akkooo and Customers. By creating an account, ordering a Product or using other Services, the Customer agrees to these General Terms. Akkooo retains order records for the period required by applicable law.

2 Seller Identification

2.2.1 The seller is Alikhtisar Alsareea for General Trading, trading as Akkooo, Al-Tanki Street 611, Al-Andalus, Al-Mansour, Baghdad 10015, Iraq (“Akkooo”).

3 Product Information and Availability

2.3.1 Information about Products, their item numbers and prices is available on the Platform.

2.3.2 Products on the Platform come from third-party stores and brands, and Akkooo buys them from those stores to fulfil the Customer’s order. Product images are provided by those stores and may not exactly match the Product’s actual appearance. Customers should rely on the descriptions and characteristics stated on the Platform.

2.3.3 Akkooo may limit the quantity or type of Products available at any time. Styles, forms and colors described on the Platform may change without notice. During purchasing, the Customer receives an automatic response if an order cannot proceed because a requested Product is unavailable. Akkooo is not liable for unavailability before the contract is concluded.

2.3.4 Akkooo is not liable for errors caused by failure of the Customer’s connection to the Platform.

4 Price

2.4.1 The total shown at checkout is in Iraqi dinars and includes all applicable customs duties and taxes. No additional customs or tax charges are collected on delivery. Delivery costs and optional services, such as insurance or faster shipping, are shown separately in the order.

5 Conclusion of the Contract

2.5.1 The essential characteristics and price of each Product are displayed on the Platform. This information does not constitute an offer by Akkooo.

2.5.2 Before placing an order, the Customer must carefully read the information given during purchasing, including any delivery charges, the Privacy Policy and these General Terms.

2.5.3 To buy a Product, the Customer must:

  1. Add the Product to the Shopping Cart using the “Add to cart” button;
  2. Review the order;
  3. Select a payment method; and
  4. Place the order through the Platform.

By placing the order, the Customer accepts these General Terms.

2.5.4 Placing an order constitutes an offer to purchase the specified Products under these General Terms and is binding on the Customer. It also entails an obligation to pay the price of the ordered Products.

2.5.5 Before placing the order, the Customer may check and correct any errors in it using the Shopping Cart, for example by adding or removing Products or changing quantities.

2.5.6 Akkooo retains orders and related Customer data for the period prescribed by applicable law, in accordance with the Privacy Policy.

2.5.7 Akkooo may reject an order at any time before it buys the Products from the supplier, in which case any amount paid is refunded in full in accordance with Section 2.13. Reasons may include:

  • Product unavailability, without prejudice to Section 2.3.3;
  • Reported or suspected fraudulent or unlawful activity, including purchases suspected to be for commercial purposes; or
  • Failure to fulfil obligations under a previous contract with Akkooo.

2.5.8 The contract is concluded when the Customer receives Akkooo’s acceptance of the order (the “Order Confirmation”). Acceptance or rejection is sent by in-app notification, SMS or email.

2.5.9 If one or more ordered Products are unavailable, the Customer is notified by in-app notification, SMS or email. The order is then cancelled, or accepted only for the available Products, and the amount paid for any unavailable Products is refunded in accordance with Section 2.13.

2.5.10 The Order Confirmation includes a summary of the purchased Products; a breakdown of the price, payment method, delivery charges and any optional services; and support contact information.

2.5.11 Once the Order Confirmation is sent, the order cannot be cancelled or modified, except as provided in Sections 2.5.7 and 2.13.

2.5.12 Risk of loss or damage passes to the Customer, or to a third party designated by the Customer other than the Carrier, when they take physical possession of the Products.

6 Payment

2.6.1 The Customer pays the price of the Products in the order, and any delivery charges, using one of the payment methods offered on the Platform at checkout. The Customer represents and warrants that the funds used for payment were lawfully obtained and are not part of any transaction intended to conceal the identity, source or destination of those funds.

2.6.2 The payment methods offered on the Platform may change from time to time. The methods available for an order are those shown at checkout.

2.6.3 The Customer pays at the time and in the manner shown at checkout for the selected payment option, such as full payment when placing the order, a deposit with the balance payable later, or payment on delivery, where offered.

2.6.4 If the payment cannot be completed, the contract is not concluded and the order is cancelled.

2.6.5 Akkooo issues an invoice for each order and provides it electronically in accordance with applicable laws. The invoice is based on the information provided when ordering and cannot be changed after it is issued.

7 Shipping and Delivery

2.7.1 Products are delivered on business days by a delivery company selected by Akkooo (the “Carrier”) to the address specified in the order. Akkooo does not deliver to post office boxes.

2.7.2 Except in cases of force majeure (as defined in Section 2.13.4), Products are delivered within forty-five (45) days of the date shown in the Order Confirmation. If delivery does not occur within that period, the Customer may cancel the order and is entitled to a refund in accordance with Section 2.13.

2.7.3 At delivery, the Customer or the Customer’s designated representative must:

  • Check that the number of delivered Products matches the delivery receipt;
  • Check that the packaging and seals are complete, intact, undamaged and unaltered;
  • Sign the delivery receipt; and
  • Present identification if requested by the Carrier.

Any damage to the packaging or Products, or any discrepancy in the number of Products or in the documents, must be recorded immediately in writing on the Carrier’s receipt. Unless applicable law provides otherwise, after signing without objection, the Customer may not object to the external characteristics of the delivered shipment, without prejudice to objections concerning Product features under Section 2.11.

8 Shipping and Delivery Confirmation

2.8.1 Akkooo notifies the Customer by in-app notification, SMS or email when the Products are dispatched and again when they are delivered.

9 Packaging

2.9.1 Products purchased through the Platform are delivered in suitable packaging, which may be the supplier’s original packaging or packaging provided by Akkooo.

10 No Returns or Exchanges

2.10.1 Products are bought from third-party stores specifically for each order. For this reason, once the Order Confirmation is sent, Products cannot be returned or exchanged.

2.10.2 Refunds are available only in the cases set out in Sections 2.5.7, 2.5.9, 2.12 and 2.13, without prejudice to any rights the Customer has under mandatory law.

11 Non-Conformity

2.11.1 If a Product has manufacturing defects or does not visibly conform to its description, the Customer must contact online support at [email protected].

12 Authenticity

2.12.1 Akkooo buys Products only from the brands’ official stores or their authorised sellers. If a Product is shown not to be genuine, Akkooo refunds the amount paid for it in accordance with Section 2.13.

13 Insurance and Refunds

2.13.1 Order insurance. At checkout, the Customer may add insurance to an order for the fee shown on the Platform. Insurance is optional, and the insurance fee is non-refundable.

2.13.2 Damaged or lost insured orders. If an insured order arrives damaged, or is confirmed lost in transit by Akkooo or the Carrier, the Customer is entitled to a full refund of the amount paid for the damaged or lost Products. Damage must be recorded at delivery as described in Section 2.7.3. Orders without insurance are not eligible for a refund for damage or loss, except under Section 2.13.3.

2.13.3 Delayed delivery. If an order, whether insured or not, is not delivered within forty-five (45) days of the date shown in the Order Confirmation, the Customer may cancel the order and is entitled to a full refund of the amount paid for the undelivered Products.

2.13.4 Force majeure. Section 2.13.3 does not apply where the delay is caused by force majeure, meaning any event beyond Akkooo’s reasonable control, including natural disasters, epidemics, war, armed conflict, civil unrest, acts of terrorism, actions of governmental or customs authorities, strikes, and interruptions to air, sea or land transport. In such cases, Akkooo will inform the Customer of the delay and complete the delivery as soon as reasonably possible after the event ends.

2.13.5 Refund timing. Akkooo issues refunds:

  • For Products that are unavailable or cancelled by the supplier, within five (5) to seven (7) business days after the supplier has refunded the full amount to Akkooo, and in any case no later than forty-five (45) days after the order is cancelled; and
  • For orders rejected by Akkooo under Section 2.5.7, insured claims under Section 2.13.2, non-genuine Products under Section 2.12 and delayed deliveries under Section 2.13.3, within five (5) to seven (7) business days after Akkooo approves the rejection, claim or cancellation.
